This End-User License Agreement (“EULA”) governs your use of the Internet Data Exchange (IDX) and Multiple Listing Service (MLS) data provided by Regional Multiple Listing Service of Minnesota, Inc., d/b/a NorthstarMLS, on the Brevig Homes website, operated by Travis Brevig with RE/MAX Results (“Broker”).
1. Grant of License
NorthstarMLS and Brevig Homes grant you a limited, non-exclusive, non-transferable license to access and use the NorthstarMLS IDX/MLS data (“Licensed Content”) on this website solely for your personal, non-commercial use in searching for real estate properties.
2. Permitted Use
You may use the Licensed Content only for personal, non-commercial purposes related to buying or selling real estate. Prohibited uses include, but are not limited to:
- Copying, redistributing, or modifying the Licensed Content;
- Using the Licensed Content for commercial purposes;
- Scraping or systematically collecting data for third-party use;
- Any unlawful activity.
3. Intellectual Property
The Licensed Content is owned by NorthstarMLS and its participants and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works from the Licensed Content without express written permission.
4. Disclaimer of Warranties
The Licensed Content is provided “as is” and “as available.” Brevig Homes and NorthstarMLS make no warranties regarding the accuracy, completeness, or reliability of the Licensed Content. Use of the Licensed Content is at your own risk.
5. Limitation of Liability
Brevig Homes and NorthstarMLS shall not be liable for any damages, including direct, indirect, incidental, or consequential damages, arising from your use of the Licensed Content or the website.
6. Termination
This license terminates automatically if you violate any terms of this EULA. Upon termination, you must cease all use of the Licensed Content.
7. Governing Law
This EULA is governed by the laws of the State of Minnesota, without regard to its conflict of law principles.
